Workers' Compensation
Injuries at the workplace are unfortunately far too common. When someone is injured while at work, there are many consequences that result and can be everlasting. The injury will require immediate medical treatment and can result in periods of temporary disability during recovery. Even after substantial treatment, an injured worker often has permanent disability which is expected to last throughout their lifetime, the need for ongoing future medical care, and the need to be trained to re-enter the workforce.
In the State of California, all employees are entitled to workers’ compensation benefits as long as the injury arose or was caused by the employment. This applies even if the employee was negligent.
Given the extent of workers’ compensation benefits provided by law, it is no surprise that employers and their insurance carriers will often deny your claim or try to quickly settle rather than deal with providing benefits and incurring expenses.

What type of injuries are covered by workers’ compensation?
Workers’ compensation is available for any work-related injury requiring medical treatment, including injuries resulting from direct physical impact, as well injuries resulting from the workplace environment, such as psychiatric, stress, and internal injuries.
Some types of injuries result in a direct onset of symptoms. Examples include falling off a ladder, or a slip and fall type injury. Other injuries, however, do not have a clear onset of symptomology. Examples include carpal tunnel that gradually develops in the wrists due to overuse as a cashier over a period of one year; or back pain that has developed gradually over the course of six months due to repetitive lifting and carrying. These types of injuries are called cumulative trauma injuries in workers’ compensation and receive the same type of protection as any other work-related injury.
